WAIVER AND RELEASE OF LIABILITY
If you are
under 18 years of age, a parent or legal guardian must sign this waiver and
have it notarized and stamped by Notary Public.
In consideration of being allowed to use the THOMASTON UPSON COUNTY SKATE PARK
facilities, I _________________________________(skater’s name) and the
undersigned, acknowledge, understand and agree that:
1. The risk of injury from the activities involved in this
activity/sport is significant, including permanent paralysis and death, and
while particular rules, equipment and personal discipline may reduce this risk,
the risk of serious injury does exist; and
2. I knowingly and freely assume all such risks, both known and
unknown, even if arising from the negligence of the releasees or others, and
assume full responsibility for my participation; and
3. I willingly agree to comply with the stated and customary
terms and conditions for participation.
These to include mandatory wearing of helmets and head protection,
mandatory signing of waiver and release of liability prior to participation,
mandatory observance of park closure times, and to report violations of any of
the above conditions for participation to Recreation Staff immediately. If I observe any unusual significant hazard
behavior/activity during my presence and participation, I will remove myself
from participation and bring such violations to the attention of the nearest
Recreation Staff Member; and
4. I understand that the Thomaston Upson County Skate Park is a
skate at your own risk facility.
5. I, for myself and on behalf of my heirs, assigns, personal
representatives and next of kin, hereby release and hold harmless the County of
Upson, the City of Thomaston, the Thomaston-Upson County Recreation Department
and Recreation Commission, their officers, officials, agents and/or employees,
or participants, sponsoring agencies, and sponsors used to provide this skate
park facility with respect to any and all injury, disability, death or loss or
damage to person or property whether arising from negligence of the releasees
or otherwise.
I have read this release of liability and assumption of
risk agreement. I fully understand its
terms and understand that I have given up substantial rights by signing it and
sign it freely and voluntarily without any inducement.

This is to certify that I, as parent/legal guardian with
legal responsibility for this participant, do consent and agree to the release
as provided above of all the releasees and for myself, my heirs, assigns, and
next of kin. I understand that the Thomaston
Upson County Skate Park is a skate at your own risk facility. I release and agree to indemnify and hold
harmless the releasees from any and all liabilities incident to my minor
child’s involvement, participation and usage of the Thomaston Upson County
Skate Park facility as provided above, even if arising from the negligence of
the releasees to the fullest extent permitted by law.
